## Summary
Class MA prior approval was granted for 15 flats in an industrial-estate unit beside a railway. The studios met NDSS as one-person units. The Inspector used new P3, which covers pollution "the product of preexisting conditions in its vicinity", to hold that railway noise must be considered under MA.2(2)(d) via W.10(b).
