Cited in: 1. DP3(3) as a "should be refused" policy; 3. The reason given for discounting CS.8
Why this is cited. This appeal shows how a design conflict engages S5(2): the proposal met S5(1)(j), but a conflict with DP3(1) without clear justification engaged DP3(3), and the benefits were “substantially outweighed”. It also treated local policies requiring development to respond to its context as consistent with the Framework, the approach to local policy that section 3 says SDC's CS.8 reasoning leaves out.
Key points
- S5(1)(j): the proposal "falls to be considered under policy S5(1)(j) of the Framework as it would address an evidenced unmet need, be physically well-related to an existing settlement" (¶37).
- Local policies are "consistent with the Framework in requiring development proposals to respond to their context" (¶39). The conflict with the spatial strategy was given moderate weight, "considering the lack of a 5-year housing land supply, I attribute moderate weight to this conflict" (¶38).
- "Policy S5(2) outlines that the circumstances in which the benefits of approving development proposals are likely to be substantially outweighed" (¶39).
- Result: "the benefits would be substantially outweighed by the adverse effects, when assessed against the national decision-making policies in the Framework" (¶42).
