Summary

A single dwelling in a side-garden gap on the rural-fringe edge of Newick was dismissed as cramped and harmful to the verdant, open transition to the countryside. The decision was issued on the Framework's publication day and does not mention the Framework at all. It is a plain s38(6) decision.

What made the difference

The gap "allows for views towards the countryside … and contributes to the rural fringe character" (DL ¶7), and the benefits of one dwelling were "limited" (DL ¶14). This is a useful reminder that some decisions of 17 August 2026 contain no Framework engagement whatever, and that no L2(1)(d) garden-infill argument was raised.

Policy findings

Policy codes are those of the National Planning Policy Framework (August 2026) unless a development plan is named.
