Summary

Two dwellings on a wooded gap in the hamlet of Howlett End, Uttlesford. The inspector accepted that the scheme was limited infilling within a group of houses under S5(1)(e), but found moderate harm to the hamlet's loose character in conflict with DP3(1), and unproven noise mitigation against the kennels next door. DP3(3) meant the scheme "should be refused", and under S5(2) the moderate housing benefit was substantially outweighed. Dismissed.

What made the difference

An infill pass under S5(1)(e) is only the principle. The site's woodland was the gap that gave the hamlet its character, so DP3(1) failed, and the kennel noise evidence was unreliable. Without the kennel neighbour, the DP3(3) character point alone would still have weighed heavily.
