Summary
One self-build house at Clavering was dismissed although the inspector found the site to be within the village and in a sustainable location, so that S4 applied. The access crossed Flood Zones 2 and 3 with no sequential test and no demonstrated safe escape route, and the self-build unilateral undertaking (UU) was too defective to secure the biodiversity net gain (BNG) exemption. Those harms substantially outweighed the benefit of one home.
Issues and findings

"Part 2(b)(i) is not met as built development within the site boundary, including access or escape routes, would be located in an area that would be at risk of flooding from any source, now and in the future" (DL ¶13). "no sequential test has been undertaken, and I have not been provided with sufficient evidence to demonstrate that there are no reasonably available sites at a lower risk of flooding" (DL ¶15).
- Safety, F7: FAIL. The flood risk assessment "does not demonstrate how the site could be safely accessed or provide definitive escape routes in a flooding event" (DL ¶12).
- Self-build and BNG: FAIL. "On the basis of what is before me I am not satisfied that the development can be considered to be custom or self-build and the proposal has also failed to demonstrate that it would make appropriate provision for BNG" (DL ¶18).
- Location: within the settlement, S4. "the site is perceived as forming part of the built area within the village. It does not perform the role of a distinct gap within the settlement" (DL ¶23).
- Accessibility: PASS. "Whilst the roads are unlit, the presence of footways and the 30 miles per hour speed limit assists in making the routes reasonably accessible for pedestrians and cyclists" (DL ¶25).
Planning balance
S4(1). Against: flood risk, substantial weight (DL ¶28); failure to meet the statutory BNG provisions, significant weight (DL ¶29). For: one dwelling at 4.77 years, substantial weight (DL ¶30); biodiversity enhancements and economic benefits, moderate weight together (DL ¶31). Self-build carried no weight as it was unsecured (DL ¶19, ¶29). "the adverse effects and policy conflicts identified in relation to flood risk and BNG are considerable and weigh heavily against the proposal, such that they substantially outweigh the benefits of the proposal" (DL ¶32).
What made the difference
The access, not the house, was in the flood zone, and that alone took the scheme outside the F5(2)(b)(i) exemption. With a sequential test, evidence of a dry or safe escape route, and a properly executed self-build undertaking, the inspector's findings on location and S4 would have supported approval.
Transferable points
- An access or escape route in Flood Zones 2 or 3 engages the sequential test under F5(2)(b)(i), even where the dwelling is in Flood Zone 1 (DL ¶13).
- An inspector may raise the sequential test where the council did not, after inviting comments (DL ¶2, ¶8).
