Summary

A dog walking field off the A51 was dismissed on highway safety at the access. The inspector applied S5 and treated TR6's refusal instruction as an S5(2) circumstance. The conclusion, though, uses the old "significantly outweighed" formula rather than the Framework's "substantially outweighed".
