Tier label used

larger village (settlement hierarchy)

The tier sentence ¶21

“Clavering is classified as a larger village”

The route sentence ¶25

“A footway opposite the site provides pedestrian access to a range of services and facilities located both to the north and south.”

Summary

One self-build house at Clavering was dismissed although the inspector found the site to be within the village and in a sustainable location, so that S4 applied. The access crossed Flood Zones 2 and 3 with no sequential test and no demonstrated safe escape route, and the self-build unilateral undertaking (UU) was too defective to secure the biodiversity net gain (BNG) exemption. Those harms substantially outweighed the benefit of one home.

The location finding

  • TR3: pass. TR3 not named but its wording used; footway opposite, services under 1 km, buses to Saffron Walden and Bishop's Stortford, unlit roads at 30 mph (DL 25)

Why this is cited

Tier brings the plan’s presumption within the built area; cited beside route evidence (footway, services under 1 km, bus stops); dismissed on flood risk and biodiversity net gain. In the register this counts as a case where the tier was cited in support of the scheme beside route or transport evidence.
